Dear Licensing Team,
I wish to submit an objection to the premises licence
application for Lebanese Grill, 62 Queens Road, Brighton BN1 3XD.
I am concerned that granting extended late-night trading
hours at this premises would undermine the licensing objectives of preventing
public nuisance and preventing crime and disorder.
Queens Road is already a busy area late at night, with
significant pedestrian traffic, takeaway customers and people leaving licensed
premises. Extending the operating hours of this premises is likely to increase
noise, disturbance, littering, anti-social behaviour and groups of people
congregating in the area during the early hours of the morning.
I am also concerned about smoke and cooking fumes generated
from the premises. The use of charcoal cooking produces noticeable smoke and
odours which can affect neighbouring properties, businesses and members of the
public. Extending the hours of operation would increase the duration of this
nuisance.
I understand that Lebanese Grill is operating from the same
premises previously known as Station Grill and that the business is connected
with the same ownership or management. Previous applications for extended
late-night trading at this location have been refused, and I respectfully ask
that the history of the premises and the reasons for those refusals be taken
into account when considering this application.
For these reasons, I believe granting this application would
have a negative impact on the local area and the licensing objectives. I
therefore respectfully request that the application be refused.

Grill agreed conditions
General
- Licensable activities shall not include the sale or supply
of hot takeaway food for immediate consumption off the
premises. After 23:00 hrs, hot food and hot drink may only be
supplied for consumption by seated customers within the premises or by
delivery to a postal address.
- Outside table and chairs will be put away at 23:00 as per
the Brighton and Hove Pavements Licence.
Delivery
- All delivery drivers / riders shall be required to remove
helmets and or face coverings whilst picking up items for delivery
(excluding any face coverings worn for faith religious reasons) within an
area that is covered by CCTV.
- The management will ensure that delivery riders / drivers
waiting or arriving to collect food orders will be parked/waiting legally
and not causing a public nuisance by way of obstructing the highway or
footpaths.
Prevention of crime and disorder
- Subject to GDPR guidance and legislation:
- Digital CCTV and appropriate recording equipment to be
installed in accordance with Home Office Guidelines relating to UK Police Requirements
for Digital CCTV System (PSDB Publication Number 09/05), operated and
maintained throughout the premises internally and externally to cover all
public areas, including the entrances/exits to the premises as well as any
outside space. The system shall be on and recording at all
times the premises licence is in operation.
- The CCTV cameras and recording equipment must be of
sufficient quality to work in all lighting levels inside the premises
at all times.
- CCTV footage will be stored for a minimum of 31
days
- The management will give full and immediate cooperation
and technical assistance to the Police in the event that CCTV
footage is required for the prevention and detection of suspected or
alleged crime.
- The CCTV images will record and display dates and times,
and these times will be checked regularly to ensure their
accuracy.
- The management of the premises will ensure that key staff
are fully trained in the operation of the CCTV, and will be able to
download selected footage onto a disk (or other electronic portable device
acceptable to Police e.g. USB) or provide footage via an online link as
initiated by Police, without difficulty or delay and without
charge.
- Any breakdown or system failure will be notified to the
police immediately & remedied as soon as practicable. This can be via
email - Brighton.licensing@sussex.police.uk
- In the event of the CCTV system hard drive being seized as
evidence as part of a criminal investigation by Police or for any other
reason, the premises will be expected to install a replacement hard drive
or a temporary replacement drive as soon as practicable.
- The premises will become a member of the BCRP or similar
scheme approved by the Licensing Authority that operates with radios and
uses the Nightsafe & Yellow Card Scheme or similar reporting
scheme.
- (a)An incident log (book or electronic) will
be maintained by the premises showing a detailed note of incidents
that occur in the premises. The log will be inspected and signed off by a
person with delegated authority at least once
a month.
(b) The log should be kept on the premises for at
least twenty four (24) months and be available for inspection at
all times the premises are open by authorised officers of the Licensing
Authority or the police. An incident will be defined as being one which
involves an allegation of a criminal offence.
- The Premises Licence Holder / Management shall ensure that
all staff members engaged or to be engaged in selling, serving or
delivering hot food and drinks shall receive induction training. This
training will take place prior to the selling, serving or delivering of
such products and will include:
- Identifying persons who are vulnerable which could include
but not limited to, their age or due to intoxication and or drugs as well
as identifying potential perpetrators.
- Conflict management. The operator will have a policy
in place assisting staff in how to deal with such situations.
(b)Further verbal reinforcement/refresher training covering
the above will be carried out thereafter at intervals not to exceed 12 weeks,
with the date and time of the verbal reinforcement/refresher training
documented.
(c)All such training undertaken by staff members shall be
fully documented and recorded. All training records shall be made available to
Sussex Police, officers of the local authority and officers from the Trading
Standards team upon request.
- Notices shall be prominently displayed by the entry / exit
door and servery as follows:
- That CCTV is in operation.
- That no alcohol may be taken into or be consumed on the
premises at any time.
- That last orders for dine in service at the restaurant
shall be at 00.30 and for home delivery shall be at 00.45.
- That no customer collections shall take place after 23.00
or during permitted licensable hours.
- Advising customers that a maximum of two (2)
people are allowed outside to smoke after 23.00.
- Requesting customers to respect the needs of local
residents and businesses, not to loiter outside and leave the area
quietly & quickly.
- SIA licensed door supervisors shall be employed on any
occasions when a requirement is identified by the licence holder's written
risk assessment or requested by Sussex Police in writing at least 48 hours
in advance. The written risk assessment will be reviewed at least once
every calendar year. The written risk assessment will take into
account information or guidance offered by the police,
and also taking into account busy periods such as Bank
Holidays, Season Variations and other City Events e.g. Football, Pride,
Music Events. The written risk assessment will be available on the
premises for inspection by police and authorised officers of the Licensing
Authority.
Public Safety –
- A Fire Risk Assessment & Emergency
Plan shall be prepared and regularly reviewed. All staff shall receive
appropriate fire safety training.
Prevention of Public Nuisance
- Appropriate notices shall be prominently
displayed by the entry / exit door and servery (See Condition 9
under Prevention of Crime & Disorder).
- A Dispersal Policy shall be prepared and regularly
reviewed. All staff shall be required to comply with its provisions.
- A direct telephone number for the premises shall be
publicly available at all times the premises is open. All complaints
shall be investigated by Management and resolved with brief details
recorded in the Incident Book.
- No noise generated on the premises, or by
its associated plant or equipment, shall emanate from the premises nor
vibration be transmitted through the structure of the premises which gives
rise to a nuisance at the nearest noise sensitive premises.
- No fumes, steam or odours shall be
emitted from the licensed premises so as to cause a nuisance to
any persons living orcarrying on business in the area
where the premises are situated.
- Commercial waste shall not be collected between the hours of
2300 and 05.00 hours.
Prevention of Children from harm
- No unaccompanied children under 16 shall be permitted to
enter or be on the premises after 23.00 or during licensed hours except in
an emergency.
